This Privacy Policy explains how Cheers To You LLC ("Cheers To You," "we," "us," or "our") collects, uses, shares, and protects information in connection with our website at cheerstoyouphotobooth.com (the "Site") and the photo experience services we provide at events and venues (together with the Site, the "Services").

By using the Site or our Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Site or our Services.

1. Information We Collect

The information we collect depends on how you interact with us:

A. Information you provide directly. When you submit an inquiry, request a quote, book an event, or otherwise contact us, we may collect your name, email address, phone number, event details (such as date, location, type of event, and headcount), and any other information you choose to share. If you book with us, we collect the information needed to perform and bill for the Services. Payment card details are entered through our third-party booking and payment provider and are processed by that provider — we do not store full card numbers ourselves.

B. Information collected at events and at the booth. When we provide a photo experience at an event, our booth captures photos, GIFs, boomerangs, and/or video of guests who choose to participate. To deliver those images, guests may voluntarily enter an email address or phone number at the booth, or scan a QR code, so we can send their photos digitally. Guests are not required to provide contact information to use the booth, and entering it is always optional.

C. Information collected automatically on the Site. Like most websites, our Site automatically collects certain technical information through your browser or device, such as your IP address, browser type, device type, pages viewed, referring website, and approximate location derived from your IP address. We collect this through cookies and similar technologies (see Section 5).

D. Information collected for corporate events and brand activations. For corporate events and branded activations, we may collect additional information in two ways. First, a client may provide us with attendee or guest-list information (such as names and email addresses) in advance so we can coordinate the event. Second, the experience may include a data-capture step in which guests choose to provide information — such as their name, email address, phone number, marketing opt-in, or responses to short custom fields — in order to receive their photos or participate in the activation. In these cases we collect this information on behalf of our client (the brand or company hosting the event) and provide it to that client, as described in Section 4. The client's own privacy policy governs how it uses information collected for its activation.

2. How We Use Information

We use the information we collect to:

  • respond to inquiries, prepare quotes, and communicate with you about your event;

  • perform, coordinate, and deliver the Services you book;

  • capture, process, store, and deliver event photos and galleries;

  • process transactions and maintain business and accounting records;

  • send you service-related messages (such as booking confirmations and event logistics);

  • send marketing or promotional communications where permitted by law (you can opt out at any time — see Section 7);

  • maintain, secure, and improve the Site and our Services; and

  • comply with our legal obligations and enforce our agreements.

3. Photos and Promotional Use

Photos and other media captured at an event are delivered to the client and, where applicable, to guests who request them.

We may also use a selection of event imagery in our own portfolio, on our website, and on our social media and marketing channels. For booked events, the terms governing this use — including the client's right to limit or opt out of marketing use — are set out in our Service Agreement and Service Terms & Conditions. We do not use images from private events for our own promotional purposes where the client has opted out under that agreement.

If you appear in an image and would like it removed from our promotional materials, contact us using the details in Section 12 and we will honor reasonable requests.

4. How We Share Information

We do not sell your personal information, and we do not rent or trade our client or guest lists for anyone else's marketing.

We share information only in the following limited circumstances:

  • Service providers. We use trusted third parties to operate our business — for example, website hosting, our booking and CRM platform, payment processing, cloud storage, and the photo-booth software we use to capture and share images. This includes Breeze (booth capture software) and Snappic (which powers digital photo sharing by QR code, text, and email, and supports data capture and galleries for activations). These providers process information only as needed to provide their services to us and are expected to keep it confidential.

  • Corporate clients and brand activations. When we run a corporate event or branded activation, information that guests provide at the experience — and any attendee data the client shares with us — is collected for and provided to that client as part of the service we perform for them. In that context we act as the client's service provider, and the client's use of the information is governed by the client's own privacy policy. We do not use information captured for a client's activation for our own marketing unless a guest separately and voluntarily opts in with us.

  • Event hosts and venues. When we provide Services at a hosted or private event, the event host or venue may receive access to the resulting photo gallery. The host or venue may have its own privacy practices, which we do not control.

  • Legal and safety reasons. We may disclose information where we believe it is reasonably necessary to comply with the law or a valid legal request, to enforce our agreements, or to protect the rights, property, or safety of our clients, guests, the public, or us.

  • Business transfers. If our business is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.

5. Cookies and Analytics

Our Site uses cookies and similar technologies to keep the Site functioning, remember your preferences, understand how visitors use the Site, and support analytics and performance monitoring. Some of these may be provided by third parties (for example, our website platform and analytics tools).

You can usually control or disable cookies through your browser settings, though some parts of the Site may not work properly if you do. Where a cookie consent banner is presented, you can also set your preferences there.

6. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this Policy, unless a longer period is required by law.

  • Event galleries and images are retained for a limited period after an event to allow for delivery, reprints, and troubleshooting, after which they may be archived or deleted. Clients who need a specific retention or deletion timeline can arrange it in their Service Agreement.

  • Guest contact details entered at a booth are used to deliver the requested photos and, where consent applies, for marketing, until you opt out or request deletion.

  • Website inquiries and booking records are retained for as long as needed to support our communications, operations, and recordkeeping, and to meet obligations.

7. Your Privacy Choices and Rights

Marketing opt-out. You can opt out of marketing emails at any time using the unsubscribe link in any marketing message, or by contacting us directly. Opting out of marketing does not affect messages we need to send to deliver a service you requested.

California residents. If you are a California resident, you may have rights regarding your personal information, including the right to know what categories of personal information we collect and how we use and share it, the right to request access to or deletion of your personal information, the right to correct inaccurate information, and the right not to be discriminated against for exercising these rights. Because we do not sell or share personal information for cross-context behavioral advertising, there is no "Do Not Sell or Share" action required — but you may still contact us to exercise the rights above.

To make a request, contact us using the details in Section 12. We may need to verify your identity before responding, and we will respond within the timeframes required by applicable law. An authorized agent may submit a request on your behalf with proper authorization.

8. Children's Privacy

Our Site and online inquiry forms are intended for adults age 18 and older, and we do not knowingly collect personal information online from children under 13. Children may appear in or use a photo booth at an event; in that case, any contact information for delivering a minor's photos should be provided by a parent or legal guardian. If you believe a child has provided us personal information directly without appropriate consent, please contact us and we will take steps to delete it.

9. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Links to Other Sites

Our Site may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites, and we encourage you to review their privacy policies.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the revised version on this page and update the "Last Updated" date above. Material changes will be communicated by reasonable means. Your continued use of the Site or Services after an update means you accept the revised Policy.
